General terms & Conditions

1. MOBILE SCHOOL commits to the delivery of the services for the client, according to the conditions agreed upon in these general conditions. Both parties are not due to acquire and/or accept any assignment, unless after a written agreement.

2. The services will be charged according to the fees specified in the purchase order. Transport costs will be charged a standard fee of € 0,50 /km. For assignments outside Belgium an extra fee will be charged to cover additional costs and time. In such case, these costs will be specified in the purchase order.

3. These fees are fixed and can be adapted in reciprocal consideration per year.

4. MOBILE SCHOOL will send an invoice 1 week after the delivery of the project. All invoices have to be paid within 14 days after the date of the invoice. For late payments an interest of 1% per month, where each month begun is considered to have expired, will be charged up to the day of the effective payment. Every disagreement with the invoice should be addressed in writing to MOBILE SCHOOL, within 14 days after the date of the invoice.

5. In case of cancellation by one of both parties a standard fee of 10% of the price (for cancellation more than 1 month before the delivery date or more than 6 weeks of the delivery date in case of an expedition) or 50% of the price (for cancellation within a month before the delivery date or within 6 weeks of the delivery date in case of an expedition) or 100 % of the price (for cancellations within 2 weeks before the delivery date or within one month of the delivery date in case of an expedition) will be owed to the party who suffers damage as a consequence of these cancellations. Force majeure is an exception.

All costs paid upfront by MOBILE SCHOOL to third parties involved in the delivery will be subject to that third party’s cancellation policy.

6.In case of postponement by one of both parties a standard fee of 25% of the price (for postponement within a month before the delivery date or within 6 weeks of the delivery date in case of an expedition) or 50 % of the price (for postponement within 2 weeks before the delivery date or within one month of the delivery date in case of an expedition) will be owed to the party who suffers damage as a consequence of these postponements. Force majeure is an exception.

All costs paid upfront by MOBILE SCHOOL to third parties involved in the delivery will be subject to that third party’s cancellation policy.

7. Cases of force majeure include - without this list being restrictive, however - war, attacks, natural disaster, illness of the trainer....

Are explicitly excluded as cases of force majeure:

- Strike

- Sickness of participants

In case of force majeure neither party is required to comply with the agreement, nor to pay any compensation. Both parties are not liable to each other in case of force majeure.

8. All materials wearing the logo of MOBILE SCHOOL and/or STREETWIZE are protected by MOBILE SCHOOL. The client can not copy, use and/or adapt these materials without written permission of MOBILE SCHOOL.

9. Movies developed and/or produced by MOBILE SCHOOL can not be copied, used and/or adapted without written permission of MOBILE SCHOOL.

10. MOBILE SCHOOL commits to handling all information received from the client, their clients, suppliers, employees, projects and investments during or as a result of the delivered service with the greatest discretion.

11. MOBILE SCHOOL commits to closing a civil liability insurance during the cooperation with the client.

12. MOBILE SCHOOL can only be held accountable for errors when the causal link between the fault and the damage can be established. In that case MOBILE SCHOOL can only be held accountable for a maximum of the amount billed to and paid by the client.

13. All disagreements as a result of the cooperation under these conditions will fall under the jurisdiction of the courts of Leuven. Only the Belgian jurisdiction applies to these general conditions.
